Welcome to degens.gg (the "Website"), owned and operated by High Score Limited ("Degens," "we," or "us"), a company registered at Hamchaku, Mutsamudu, Autonomes Island of Anjouan Union of Comoros, under the Commercial Register of the Chamber of Commerce and Industry in Anjouan with registration number 15613. Degens operates under Offshore Finance Authority of The State of Anjouan, under The Computer Gaming Licensing Act 007 of 2005.

2. General Terms

2.1. These Terms of Service govern your access and use of the Website and associated services (the "Services"). By using the Website or Services, you agree to these Terms of Service. If you do not agree, please discontinue your use immediately.

2.2. We reserve the right to update or amend these Terms of Service at any time. Material changes will be communicated (e.g., via notifications at login). Continued use of the Website or Services after any updates constitutes your acceptance of the revised terms. It is your responsibility to review these Terms regularly.

2.3. While these Terms may be provided in multiple languages, the English version shall prevail in the event of any discrepancies.

2.4. Specific games, lotteries, or betting markets available on the Website may have additional rules. In case of conflict, these Terms of Service will take precedence.

3. Account Registration

Degens reserves the right to reject usernames deemed offensive or inappropriate.

• You provide false or misleading information or attempt to register through third parties. Additionally, the sale, transfer, or acquisition of Accounts is strictly prohibited.

3.3. You are solely responsible for safeguarding your login credentials, cryptocurrency wallets, and associated private keys. Degens shall not be liable for losses arising from unauthorized access due to your failure to secure this information.

3.4. Users are allowed only one Account. If multiple Accounts are detected, they may be suspended or closed, and funds in these Accounts may be frozen or deducted. If you inadvertently create multiple Accounts, contact us immediately at support@degens.gg.

3.5. If you identify any errors or incorrect information in your Account, you must notify us promptly by emailing support@degens.gg.

4. Know-your-customer (KYC)

4.1. We reserve the right, at any time, to ask you for KYC documentation if we deem it necessary in order to determine your identity, location or age, or for any other purpose. We reserve the right to restrict your ability to access any or all Services or to make payments or withdrawals until your identity has been determined to our satisfaction, at our sole discretion.

4.2. We reserve the right to disclose your information to third parties as appropriate to comply with any legal process or as otherwise permitted under our privacy policy, and by using any Service, you acknowledge and consent to the possibility of such disclosure. 5. Conditions of use

5.1. As a condition of your use of the Services, you represent, warrant, covenant and agree that:

• You are the older of (i) 18 years of age and (ii) the legal age determined by any laws applicable to you regarding your use of the Website and the Services;
• You have full capacity to enter into a legally binding agreement with us and you are not restricted by any form of limited legal capacity;
• Your use of the Services is at your sole option, discretion and risk;
• You are fully aware that there is a risk of losing funds when using the Website and the Services and you agree that we bear no responsibility to you for any such loss;
• You acknowledge that the funds in your Degens Account are consumed instantly when playing games and that we do not provide refunds;
• You accept and acknowledge that the prevailing market value of cryptocurrencies can change dramatically;
• You have not been diagnosed or classified as a compulsive or problem gambler;
• You are not currently self-excluded from any gambling site or gambling premises, and you will inform us immediately if you enter into a self-exclusion agreement with any gambling provider;

• You will not collude with or assist, or attempt to collude with or assist, any third parties, or use any device, robot, algorithm, software, routine or other method (or anything in the nature of the foregoing), in order to defraud us or interfere with the functioning or operational performance of the Website or the Services;
• You will not use the Website or Services in any way which interferes or may interfere with other users, or make any attempt to gain an unfair advantage over other users, whether specifically prohibited by the applicable rules or not;
• You will not disseminate any information which is unlawful, harassing, abusive, threatening, libellous, defamatory, obscene, indecent, inflammatory, racially or ethnically objectionable, pornographic or profane, or any material that could constitute or encourage conduct that would be considered a criminal offence or could give rise to civil liability;
• In relation to deposits and withdrawals of funds into and from your Degens Account (including cryptocurrencies and any other currencies that may be used), you will only use funds which have been legally obtained and which belong to you. You will not use funds which originate from criminal or other illegal or unauthorised activities;
• You acknowledge that we may take measures to detect and prevent unauthorised or illegal activity. These steps may include, but are not limited to, examination of your device properties, geolocation, detection of IP masking, and blockchain transaction analysis;
• If you become aware of any suspicious activity relating to any of the games on the Website, you will report this to us immediately by contacting us by email at support@degens.gg;
• You acknowledge that we may suspend, block or close a Degens Account and withhold funds if we deem it necessary to assist in the prevention of money laundering or other illegal activity;
• You are fully and solely responsible for obtaining your own independent financial, accounting and tax advice, and for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on any winnings or other sums that you receive from using the Services;
• You will keep your username, password and cryptocurrency wallet private keys confidential and take appropriate steps to prevent unauthorised access or use;
• You will immediately change your password and notify us if your username or password is compromised in any way;
• You agree not to open more than one Degens Account;
• You acknowledge that we may modify or withdraw any of the Services at any time without prior notice to you; and
• You acknowledge that we are not liable for any outages, slowness, capacity constraints or other deficiencies affecting the telecommunications networks or internet services required for you to access and use the Services.

5.2. We will be entitled to close or suspend your Degens Account in the event of a breach of any of the above representations, or if we consider it likely that there has been or will be any such breach. We may also close or suspend your Degens Account if asked to do so by the police, any regulatory authority or court or if we are unable to verify any of the KYC information provided by you.

6. No Warranties from Degens

6.1. The Services are offered on an "as is" and "as available" basis, with no guarantees or warranties of any kind, whether express or implied. We do not warrant or represent the quality, accuracy, reliability, suitability, or completeness of the Services. 

Degens does not guarantee that: 

• The Services will function without interruptions, errors, bugs, or defects. 
• Access to the Services will be continuous, timely, secure, or error-free. 
• Any identified issues will be corrected. 

Specifically, we cannot assure that the Website will be free from operational defects, viruses, or harmful components, nor that it will meet your specific needs or expectations. Information displayed on the Website, such as data feeds for sports betting, may not always be accurate, reliable, or up-to-date. Factors such as software errors, interruptions in data feeds, platform downtime in casino games, or server issues may result in operational disruptions or financial losses.

6.2. In some cases, Degens may release new games or features in a beta testing phase. By choosing to use Beta Features, you acknowledge and accept that they may be unstable, contain errors, or experience operational issues. Degens assumes no responsibility for any losses you may incur as a result of using Beta Features.

Beta Features are subject to change and may be suspended, modified, or removed at any time without notice. Degens reserves the right, at its sole discretion, to adjust or deduct any winnings credited to your Account due to technical or human errors arising from the use of Beta Features.

7. Prohibited Uses

7.1. Using the Website or Services for illegal activities, including but not limited to money laundering, terrorist financing, or violations of trade sanctions, is strictly prohibited.

7.2. The Website and Services are not available to individuals or entities in the following territories Australia, Austria, Comoros, France, Germany, Netherlands, Spain, United Kingdom, USA, all FATF Blacklisted countries, Sanctioned countries and/or any other jurisdictions deemed excluded by the Anjouan Offshore Financial Authority.

7.3. Attempts to conceal your true location through VPNs, proxies, or by providing false or misleading information about your residence or location constitute a breach of these Terms of Service.

8. Deposits

8.1. Participation in Degens games requires sufficient funds in your Degens Account.

8.2. Funds deposited into you Degens Account must not originate from illegal or unauthorized activities.

8.3. Deposits can be made from your cryptocurrency wallet or via other payment methods available on the Website. All deposits must be made using your own funds.

8.4. Degens is not responsible for delays in deposits caused by blockchain transaction times, specific payment methods, or third-party issues.

8.5. We reserve the right to conduct additional identity verification procedures for deposits.

8.6. Some payment methods may incur additional fees. Your bank or payment provider may also charge fees for transfers or currency conversions.

8.7. We may decline deposits at our discretion. If your Degens Account is suspended or blocked, you must not attempt to deposit funds. Any funds deposited during suspension or blockage may be permanently lost, or retained by Degens if not lost.

9. Withdrawals

9.1. Cryptocurrency withdrawals will be processed to the wallet address you provide, subject to a valid withdrawal request.

9.2. Withdrawal requests may be restricted if suspicious, unauthorized, or illegal activity is detected in your Degens Account.

9.3. In the event of an erroneous credit to your Account due to technical or human error, the credited funds remain Degens's property and may be deducted. If you become aware of such an error, you are obligated to notify us immediately at support@degens.gg. Withdrawing funds that do not belong to you constitutes a debt owed to Degens.

9.4. If your Account is closed, locked, or excluded, you may contact our support at support@degens.gg to recover remaining funds. We reserves the right to deny account reopening, unlocking, or withdrawals if there is suspicion of a breach of these Terms or if deemed necessary. Additional KYC or verification procedures may apply.

10. Winnings and Bonuses

10.1. Winnings will be paid out in the same currency or asset used for placing the original wager or bet.

10.2. From time to time, we may offer bonuses or rewards (collectively, “Bonuses”), such as free spins, cashback, free bets, or additional funds/assets for gameplay. Participation in promotions involving Bonuses is subject to specific terms and conditions, which you must agree to before participating. We reserve the right to alter, discontinue, or cancel promotions or Bonuses at any time. Eligibility to receive Bonuses is determined solely at Degens’s discretion.

10.3. We retains the right to remove Bonuses from inactive accounts or from accounts found to be exploiting or misusing the Bonuses in bad faith.

10.4. Bonuses must be claimed within 60 days or any shorter period specified in the promotion’s terms. Unclaimed Bonuses may be cancelled at Degens’s sole discretion.

10.5. Users are only eligible to receive winnings or Bonuses if they fully comply with these Terms of Service.

11. Sports Betting

11.1. We may provide sports betting opportunities (“Markets”) across various events, including pre-match and in-play betting, as well as single and multi-bets. The availability of specific sports or events is subject to change without prior notice.

11.2. Sports data and analytics are provided by third-party providers (“Third-Party Content”). Degens does not endorse, guarantee, or take responsibility for the accuracy, reliability, or completeness of Third-Party Content, and you use it at your own risk.

11.3. Third-party providers may establish rules for settling Markets. You are responsible for reviewing these rules before placing bets.

11.4. Markets will be settled only after official confirmation of the event’s outcome or at Degens’s sole discretion. If the outcome cannot be officially verified, Degens reserves the right to void the Market. In cases where a match is interrupted but completed, Markets will be settled according to official results.

11.5. If a match significantly deviates from its expected format or rules, We may void associated Markets.

11.6. For matches that are incomplete or not played (e.g., due to disqualification, interruptions, or cancellations), undecided Markets will be void unless the outcome has already been determined.

11.7. Bets placed on outcomes already decided at the time of the wager will be void, and winnings may be withheld or refunded accordingly.

11.8. If displayed or calculated prices are incorrect, we reserves the right to void bets related to those errors.

11.9. Bets are void for postponed, cancelled, or abandoned matches unless specifically indicated otherwise. For partially determined Markets, such as “First Team to Score,” bets will stand if the Market is fully resolved before the interruption.

11.10. If a Market is settled incorrectly, we reserves the right to adjust the settlement at any time.

11.11. The “Cash Out” feature allows users to settle a bet early for a specified return. The amount is credited to your account immediately upon using the Cash Out option, and the bet is concluded, regardless of the event’s final outcome.

11.12. Additional rules for the Cash Out feature include:

• Not all Markets or events offer the Cash Out feature.
• A time delay applies to all Cash Out attempts.
• Cash Out will be unavailable during event suspensions or if odds change during the time delay.
• If Degens does not provide live coverage for an event, Cash Out will be unavailable after the event begins.
• The Cash Out amount may differ from the original stake and is determined based on the event’s progression.
• We reserves the right to reverse settlements of Cash Out bets made in error.
• Degens is not responsible for technical issues preventing the use of the Cash Out feature. In such cases, bets will be settled based on the final event outcome.
• Misuse of the Cash Out feature or breaches of these Terms may result in revocation of access to the feature.

12. Breach

12.1. If you violate any part of these Terms of Service, in whole or in part, we reserve the right to take any actions we deem necessary. These actions may include, but are not limited to, suspending or closing your Degens Account, deducting funds from your account, terminating our agreement with you, or initiating legal proceedings. 

• 12.2. You agree to fully indemnify and hold harmless Degens, along with its shareholders, directors, employees, and agents, against any costs, expenses, losses, damages, claims, demands, or liabilities (including legal fees) incurred as a result of: 
• your breach of these Terms of Service; 
• your violation of any law or third-party rights; or 
• your misuse of the Services. 

13. Limitation of Liability

13.1. Degens shall not be liable for any claims, liabilities, losses, or damages of any kind, including direct, indirect, incidental, special, or consequential damages (e.g., loss of business profits, interruptions, or loss of information) arising from your use or misuse of the Services. This limitation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal basis, even in cases of negligence or if we were informed of the possibility of such damages.

13.2. The above limitations apply to the fullest extent permitted by applicable law. 

14. Intellectual Property 

14.1. Degens and its licensors retain all rights to the Services, including their code, structure, and organization, as well as associated copyrights, trade secrets, and intellectual property. You may not copy, distribute, publish, reverse engineer, decompile, modify, or use the Services in violation of applicable laws. Any unauthorized use (“Unauthorized Use”) will result in your sole liability for any related damages or expenses. You must notify us immediately if you become aware of any Unauthorized Use and cooperate with our investigation. 

14.2. Degens owns all trademarks, domain names, and related intellectual property (“Trademarks”), as well as all content on the website, including text, images, graphics, videos, and audio (“Site Content”). You do not acquire any rights to the Trademarks or Site Content by using the Services. You may not use Degens’s intellectual property without prior written consent and must avoid actions that could harm or infringe upon our rights.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws in force in the state of Anjouan in the Union of Comoros.

18. Severability

If any provision of these Terms and Conditions is found by a competent authority to be invalid, unlawful, or unenforceable in any way, that provision will be severed from the remaining terms, which will remain valid and enforceable to the fullest extent permitted by law. In such instances, the invalid or unenforceable provision shall be modified, as required by applicable law, to align as closely as possible with the original intent of High Score Limited.

19. Assignment

Degens reserves the right to assign its rights and obligations under these Terms of Service without notice. You may not assign your rights or obligations under these Terms. 

20. Miscellaneous

20.1. Failure to enforce any provision of these Terms of Service does not constitute a waiver of that provision or any subsequent breach. 

20.2. These Terms of Service do not create rights or benefits for third parties. 

20.3. Nothing in these Terms of Service establishes a partnership, agency, trust, fiduciary relationship, or joint venture between you and Degens. 

20.4. Communications regarding the use of the Services may be retained for up to six years. 

20.5. These Terms of Service represent the entire agreement between you and Degens regarding the Services, superseding all prior agreements or understandings.
